I got this question today: "This might be a weird question, but do you know who (if anyone) owns the copyright to the rubberduck image? I work on a lifestyle tv show, and one of the people whose house we were filming in had a collection of yellow rubberducks (I think he bought them at IKEA). Is the image public domain?"
And my response: "I'm not certain but, at least in the US, a picture is the property of the photographer and can be copyrighted by them. As far as I know, it doesn't matter what the content is (excepting people), it matters who created the image."
So, fellow quackers, I'm pretty sure I'm correct, but does anyone know? Is it possible to have the rights to the rubber duck "image"?
